Intellectual property
The CropPlanner software, its interface, its source code and its documentation, together with the text, illustrations and graphic elements of this site, are the exclusive property of the publisher and protected under French intellectual property law.
Any reproduction, representation, adaptation, translation or distribution, in whole or in part and on any medium, is prohibited without prior written permission. Buying a CropPlanner licence grants a right to use the software; it transfers no ownership.
Third-party trade marks and product names mentioned (Adobe Photoshop, Capture One, macOS, Apple) belong to their respective owners and are cited for interoperability purposes only.
Personal data and cookies
This site uses no analytics and sets no cookies of its own. It contains no forms of its own.
It does, however, load the Paddle checkout script (cdn.paddle.com) on every page. Your IP address is therefore passed to Paddle, which uses it to determine your country and show prices in your currency, and which may set cookies of its own. Those operations are Paddle's; its privacy policy is published at paddle.com.
If you take out a subscription, the details entered at checkout — name, billing address, payment method, VAT number where applicable — are collected by Paddle as the reseller. The publisher never has access to your payment method; it receives from Paddle only what is needed to issue your licence and keep its accounts.
Information you send to the publisher by email is used only to reply to you, issue a licence and keep the accounts. The controller for those operations is the publisher identified above; the legal basis is performance of the contract and compliance with accounting obligations.
This data is kept for the duration of the business relationship and then for the statutory retention period for accounting records (ten years). It is never sold, assigned or passed to third parties, save where the law requires it.
Under Regulation (EU) 2016/679 and the French Data Protection Act, you have the right to access, rectify, erase, restrict, object to and port your data: write to martinjoly.pro@gmail.com. You may also lodge a complaint with the French data protection authority, the CNIL (cnil.fr).
What the software sends, and what it doesn't
The CropPlanner application works offline. Your images, your crops and your settings stay on your computer: none of it is sent to the publisher, and no usage data is collected — no statistics, no file names, no automatic reports.
It makes exactly three requests to our servers, and you know which. Activation, when you click Activate: it sends your key, a machine identifier, your Mac's name and the application's version number. Renewal, once a day while a licence is installed: it sends your licence and the same three items. Update check, each time the app opens and then once a day, unless you turn it off in Preferences: it reads the number of the latest version published on our website, as a browser would, and sends no key, no machine identifier and no version number.
The machine identifier is the one macOS assigns to the hardware; it tells us which computer holds the licence — one licence, one computer — and nothing else. Your Mac's name is there to tell you which one, the day you move your licence. We log the country these requests come from, never the IP address.
Sales and licences
CropPlanner subscriptions are taken out directly on this site. Payment, invoicing and tax are handled by Paddle, acting as the publisher's authorised reseller: Paddle sells the subscription to the buyer, issues the invoice and collects the tax due in the buyer's country. Depending on that country, the seller is Paddle.com Market Limited (registered in England and Wales under number 8172165, 30 Old Bailey, London EC4M 7AU, United Kingdom), Paddle.com Inc. (United States) or Paddle.com (Canada) Ltd.
The right to use the software is granted by the publisher identified above: whichever channel the purchase goes through, the licence is issued by the publisher and binds the user to the publisher.
Prices shown on this site are stated in euros exclusive of tax and may change without notice. The amount actually due — tax included, in the buyer's currency — is the one shown at checkout when the order is placed, and that is the binding figure. EU businesses may enter their VAT number there to be invoiced under the reverse charge.
The terms of sale applying to the transaction are the reseller's, accepted at the time of payment. For any question about an invoice or an already-issued licence, write to martinjoly.pro@gmail.com.
Liability
The publisher endeavours to keep this site accurate and up to date, without warranting the accuracy, completeness or currency of the information it contains. Depictions of the software interface are illustrative and not contractually binding.
Access to the site may be interrupted at any time, in particular for maintenance, without liability on the part of the publisher. Outbound links are provided for information only: the publisher exercises no control over the sites they point to.
Governing law
This site and the relationships arising from it are governed by French law. In the event of a dispute, the parties will seek an amicable settlement before any legal action; failing that, jurisdiction is as set out in the general terms and conditions of sale or, in their absence, under ordinary rules of law.
